The Labour Court rejected Thomas Clarke’s appeal against the decision on his employment-transfer complaint against Sodexo Ireland Limited. The determination was dated 19 December 2016. Clarke said Sodexo failed to consult him properly about the transfer of his employment after it lost a catering contract, and did not pass on details of his employment terms.
The Court found that Sodexo consulted affected staff and provided the required information. It also found the transferred files included all relevant contracts: Clarke’s 8-plus-hour contract was administered as 16 hours of weekend work, while a second, as-and-when-required contract was no longer active. The Court found the complaint not well founded, affirmed the Adjudication Officer’s decision and disallowed the appeal.
