The Labour Court allowed Ballymun Regional Youth Resource’s appeal and set aside an adjudication officer’s decision that Mark Davis was entitled to a redundancy lump sum. The Court found that Davis transferred to Star when the outreach team and its essential HSE funding moved to the provider on 1 January 2022.
The decision, dated 16 May 2024, said Davis had worked as a youth outreach worker since 2002. Although the Court criticised the employer’s handling of the situation and its failure to consult, it concluded that a transfer of undertakings had occurred and that Davis was not dismissed by reason of redundancy. The appeal therefore succeeded.
