The Labour Court overturned the decision on Joseph Clarke’s redundancy claim, finding him entitled to a payment calculated using weekly pay of €823.89. The final payment is to be calculated under the statutory schedule. Clarke had worked for James C. Byrne Manufacturing Limited T/A Byrnes Jewellers for 40 years before being made redundant on 2 November 2020. The parties agreed he had received no redundancy payment. The company argued it had been dissolved, but the Court said it had received no evidence establishing that. The Court found the redundancy claim well founded and set aside the Adjudicator’s decision. Its determination was dated 5 December 2022.
