The Labour Court found that Darren Redmond, trading as Foxrock Paving, was not a building firm covered by the construction industry registered employment agreement, rejecting Unite’s complaint over pension contributions. The decision was signed on 20 September 2010. Unite said the firm was covered by the agreement but had not contributed to the Construction Workers Pension Scheme. It sought an inspection of the company’s records to establish arrears and an order requiring payment. Redmond said the business mainly carried out soft landscaping and related work outside the agreement. The Court said a landscaping contractor could fall within the agreement depending on the work it performed. On the evidence, it found Redmond was not a building firm within the agreement’s meaning.
