The Labour Court directed HSE West to treat Susan Delaney's sleepover time as working time and pay her €500 under a Rights Commissioner's decision. The determination was dated 23 September 2010. Delaney, represented by the Services Industrial Professional Technical Union, complained that HSE West had not implemented the earlier decision. The Court recorded that the decision had not been carried out and that no appeal had been brought within the time limit. It determined that HSE West must comply with the Organisation of Working Time Act 1997 by treating sleepover time as working time and paying the €500 specified in the Rights Commissioner's decision.
