Labour Court finds A1 Paving outside construction agreement

The Labour Court found Patrick Redmond Trading As A1 Paving was not a building firm covered by the construction industry agreement, rejecting a complaint brought by Unite the Union. The decision was dated 20 September 2010. Unite said A1 Paving had failed to make contributions to the Construction Workers Pension Scheme and sought an inspection of company records to establish any arrears, along with an order requiring payment to the scheme. A1 Paving said its principal business was soft landscaping, which was outside the agreement. The Court said a landscaping contractor could fall within the agreement depending on the work performed, but found the evidence showed A1 Paving was not a building firm within its meaning.
