Labour Court rules concrete pumping firm is covered by construction agreement

By Aoife Loughran

Labour Court ·

The Labour Court determined that Concrete Pumping Limited was a building firm covered by the construction industry Registered Employment Agreement. The decision was signed on 15 June 2010, following a complaint by Unite the Union about workers’ pension, assurance and sick-pay coverage. The company said it supplied hired plant services and its pump-truck drivers were not construction operatives. The Court found that employees operated the pumps and helped spread and lay concrete on construction sites, making their work an integral part of construction. It classified those employees as general operatives covered by the agreement. The parties were to discuss whether existing pension and mortality cover met the agreement’s requirements. If they could not agree, the Court said it would reconvene and make a further determination.
