Labour Court dismisses union complaint against Sincon Engineering

The Labour Court dismissed Services Industrial Professional Technical Union’s complaint that Sincon Engineering Ltd breached the construction industry Registered Employment Agreement on wages and conditions. In its decision dated 10 December 2007, the Court found the agreement did not cover the company. The union argued that a worker should have received the agreement’s General Operatives Grade 3 rate. Sincon said its steel fabrication and engineering work was outside the agreement and the worker was principally employed as a driver. The Court noted that on-site labour costs were 4.53% of the company’s turnover during the period examined.
