The Labour Court found the Construction Federation Operatives Pension Scheme’s complaint against P A Dunne Construction Ltd was not well founded. The decision was dated 15 July 2004. The scheme said the company was covered by the construction industry agreement on pensions, assurance and sick pay and sought compliance from 17 December 2001. The company argued it was an employment agency outside the activities covered by the agreement. The Court found the company was not covered by the agreement and that a separate agreement dated 17 October 2001 did not form part of it.
