The Labour Court varied an earlier decision after finding it had no jurisdiction under the Payment of Wages Act to decide Dainis Jirgens’s claim that C&D Foods Limited failed to pay notice entitlements. The Court signed its decision on 28 November 2024. Jirgens said he was owed pay in lieu of notice and outstanding annual leave when his employment ended. C&D Foods said holiday entitlements had been paid and initially said notice pay was not due because it dismissed him for gross misconduct. The parties agreed notice pay was due, but disputed whether it amounted to one or two weeks’ pay.
Labour Court says it lacked jurisdiction over notice-pay claim against C&D Foods
