Labour Court rejects Alicja Stadnicka-Szymus’s late appeal against An Garda Siochana

The Labour Court found Alicja Stadnicka-Szymus’s Payment of Wages Act appeal was outside the time limit and refused her request to extend it. Dated 7 December 2023, the Court said it had no jurisdiction to hear the appeal; the merits were not decided. The Adjudication Officer had found her complaint against An Garda Siochana not well founded. The appeal deadline was 24 July 2023, but the Court received it on 26 July. Stadnicka-Szymus said she believed the 42-day period began the day after the decision and posted her appeal on 25 July. She also cited the summer holidays and waiting for documents. The Court found these circumstances did not establish that exceptional circumstances had prevented her from appealing in time.
