The Labour Court overturned a €33,346.91 award to Martin Switzer after the Department of Justice’s appeal succeeded. In its determination dated 31 October 2023, the Court found that the €1,197.50 payment he received reflected the wages properly payable to him. Switzer said he expected an annual allowance of €18,023 for taking up a role in the Department’s Immigration Border Management Unit. The Department argued that an allowance required approval from the Department of Public Expenditure and Reform, which sanctioned €2,874 a year. The Court found Switzer had no contractual or other entitlement to an allowance at a specified level. It concluded that no unlawful deduction from his wages had occurred and set aside the Adjudication Officer’s award.
