Labour Court dismisses Dureza Sumayao’s Payment of Wages appeal as late

The Labour Court dismissed Dureza Sumayao’s appeal over a Payment of Wages Act complaint against Noonan Services Group Ltd as out of time. The Court’s determination was dated 20 October 2022. The adjudication officer had found the complaint well founded. Sumayao’s appeal was received on 28 January 2020, one day after the 42-day deadline. She said she had not secured a solicitor and thought she had posted the appeal in time. The Court found those reasons did not amount to exceptional circumstances justifying an extension. The appeal failed because it was late; the complaint’s merits were not decided. The employer’s separate appeal was to be heard in a fresh hearing of the original complaint.
