Labour Court orders Bus Éireann to pay driver for hours worked

The Labour Court directed Bus Éireann to pay driver Liam McShane for hours he worked on 15 January 2020, while finding that no pay was due for three other occasions when he did not attend work. The Court varied the Adjudication Officer’s decision in its determination dated 12 September 2022. McShane argued that shifts he was asked to work exceeded legal limits on driving hours and that withholding pay breached the Payment of Wages Act. Bus Éireann denied the claim but accepted he was owed pay for other duties he performed on 15 January. The Court directed payment for those hours. For the other occasions, it found his refusal to work was not grounded in law and no remuneration was properly payable. The merits were decided.
