In a determination dated 16 December 2020, it found the public holiday complaint was out of time and varied the award for annual leave accrued during certified sick leave. The Court found Banville had accrued 27.33 days of annual leave, worth €2,664.67 at his daily rate of €97.50. After deducting €62.19 already paid, it determined that €2,602.48 was due. The original award was €3,467.81, including €400 for public holidays.
