The Labour Court varied an Adjudication Officer’s decision on Tusla Child & Family Agency’s appeal, directing it to pay Rita O’Neill €1,191.12 in compensation for an unlawful wage deduction. The determination was dated 2 November 2020.
The parties agreed that O’Neill was due €21,977.39 in wage arrears, but Tusla paid her €20,785.27. The Court found the €1,191.12 difference was an unlawful deduction during the period covered by her complaint. The original decision had awarded her €6,461; the Labour Court varied that decision and directed payment of €1,191.12.
O’Neill also argued that Tusla had promised a further €5,268.94 and that errors in its increment calculations had caused additional deductions. The Court found no basis for either claim. Tusla said it had correctly calculated and paid the wages due, taking account of pay movements and public service agreements. The Court rejected Tusla’s argument that the shortfall was an error of computation.
