The Labour Court upheld Emer Moran’s penalisation complaint and awarded her €20,000 after finding that managers’ handling of her pay concerns led to the termination of her employment. It also awarded her €92 for an October 2017 public-holiday underpayment and recommended €1,000 redress for constructive dismissal. The determination was signed on 16 December 2019.

Moran had appealed decisions and recommendations arising from her WRC complaints. She said she was dismissed after raising concerns about Sunday-premium and public-holiday pay; Trident Associated Securities Kommunications Ltd- T/A Task said it believed she had resigned. The Court found that managers deflected her concerns and that she would likely have continued working had she been treated differently after asserting her rights under the 1997 Act.

The Court found her three-days’ pay claim not well founded. It had no jurisdiction over two purported appeals concerning alleged bullying and harassment, and a second constructive-dismissal reference restated the other claim. Moran withdrew a number of other matters before or at the hearing.
