Labour Court upholds three-days’ pay award to David O’Connor

The Labour Court upheld a three-days’ pay award to David O’Connor after his appeal over notice entitlement failed. The determination was signed on 4 November 2019. O’Connor argued that his contract included an implied entitlement to four weeks’ notice. VF Foods Limited disputed this, and the Court found no evidence of such a term or of a relevant custom and practice. It found that the statutory one-week notice period applied. The Court agreed with the Adjudication Officer, who had awarded three days’ pay in lieu of notice, and the appeal failed.
