Labour Court rejects Vasco Lechner’s late pay complaint against Starwood

The Labour Court disallowed Vasco Lechner’s appeal against Starwood Reservations Corporation on 2 November 2016, finding his pay complaint was outside the time limit and that it had no jurisdiction to hear it. The merits were not decided.

Lechner alleged that Starwood failed to pay him appropriate remuneration and incentive payments for his Ambassador Team role. He referred the complaint in October 2015 over alleged contraventions dating back to December 2009. Starwood denied the allegations and argued that the claim was late.

The Court said the complaint was brought almost two years after the alleged contraventions and could not be saved by the extended time limit. It noted that Lechner went on sick leave in October 2013 and was not paid after his sick pay ended in December of that year because he was unavailable for work.
