The Labour Court rejected Dimitrij Karpenko’s appeal against Freshcut Food Services Ltd over his minimum-wage claim, affirming the Rights Commissioner’s decision. The determination was dated 9 February 2017. Karpenko argued that his written work schedule entitled him to minimum-wage pay for 66 hours in a pay period. The Court found that he worked 33.47 hours and received €337.50 gross, equal to €10 an hour, above the then minimum rate of €8.65. It held that he was entitled to the minimum wage for hours he actually worked, not hours he did not work or was not required to work.
