The Labour Court set aside a €29,137.83 wage-arrears award to Anatoliz Aizbel after allowing John O’Connor’s appeal. The determination was signed on 14 June 2013.
Aizbel said he had worked as a farm labourer for O’Connor from 10 May 2010 to 11 September 2011 and had been paid below the national minimum wage. O’Connor denied employing him, saying he had only paid him for occasional jobs.
The Court preferred the evidence from O’Connor’s witnesses and found Aizbel had not proved he was employed or that they had mutual obligations to provide and perform work. It set aside the Rights Commissioner’s award.
