The Labour Court recommended that HSE West pay a worker €3,700 after finding it mishandled and delayed her request for an SQA allowance. The recommendation was dated 15 December 2025.
The worker sought reinstatement of the allowance in April 2024 and sent emails and information over the following months without receiving an outcome. She raised a grievance that was upheld, then overturned at the next stage. At stage three, she was told eligibility for the allowance fell outside the grievance procedure. HSE West said she was not eligible for the allowance in her role.
The Court said the issue before it was how the claim had been handled, rather than whether the allowance should be paid. It noted that the worker waited seven months for a definitive answer and that no explanation was given for not telling her earlier that the matter was outside the grievance procedure. The Court recommended €3,700 compensation.
