The Labour Court recommended that the Health Service Executive make a €25,000 ex-gratia payment to a worker after a prolonged dispute over special leave with pay under a national long COVID scheme. The recommendation, dated 9 November 2023, followed the employer’s appeal of an earlier recommendation for €127,120.75 and continued treatment under the scheme. The worker had tested negative for COVID-19 twice in April 2020. The employer said that meant she did not qualify; her union argued that a footnote to the circular allowed access in some circumstances. The Court said it would not interpret the circular or recommend conceding the claim, but recommended the payment as a goodwill gesture, citing hardship caused by the delay.
