The Labour Court recommended that the Health Service Executive make a €3,000 ex-gratia payment to a worker after delays in handling her application to the Serious Physical Assault scheme. The recommendation, dated 9 November 2023, also says her application should proceed to a final appeal before a senior manager in the HSE’s National Employee Relations division. The employer had appealed an earlier recommendation for a €3,000 payment and access to an appeal process. The Court said both parties acknowledged that the matter had been delayed beyond what either considered acceptable. It described the assault as alleged; the recommendation does not determine whether it occurred.
