The Labour Court recommended that the Health Service Executive provide a worker with relevant pension paperwork by 31 October 2019, after the HSE said it had finalised its calculations and pension arrears were no longer accruing. The recommendation was signed on 14 November 2019.
The case also concerned a disciplinary sanction linked to the worker’s allegation of penalisation for seeking pension rights and reporting wrongdoing. The Court said the sanction issue could not properly be before it while an internal appeal was pending, and recommended that any issue arising from that appeal be taken to an Adjudication Officer through the normal process.
