The Labour Court recommended that the Health Service Executive place a worker on the pay scale appropriate to her HR/IR Officer role and pay her €7,500 compensation for delay. The recommendation was dated 29 August 2019.
The worker had appealed an adjudication officer’s recommendation, saying her duties matched those of a colleague graded as an Executive. The HSE said her role could be viewed as Grade VIII but that she would need to succeed in a competition to be appointed to that grade. The Court did not support placing her on a historic scale with no appointments for many years. It found the HSE’s position unsustainable because it considered her role appropriate to Grade VIII while continuing to pay her as an HR/IR Officer. The Court also recommended €7,500 compensation for delay in addressing the pay-grade anomaly.
