The Labour Court recommended that Avara Shannon Pharmaceutical Services Ltd and SIPTU return to local discussions to agree revised ex-gratia redundancy terms, with Workplace Relations Commission assistance if needed. It also recommended discussing the retention of as many workers as practicable during any decommissioning work. SIPTU sought assurances that the company would honour terms recommended in 2009 if it closed. The company said it could not afford those terms, estimating their cost at €15.35 million. The Court recognised workers’ expectation of an ex-gratia payment if no buyer was found while noting the company’s financial difficulties. The recommendation was dated 27 May 2019.
