The Labour Court rejected Patrick Mooney’s appeal over holiday premium pay from Rotunda Hospital FN the Rotunda Hospital, upholding the adjudication officer’s recommendation. The decision was dated 25 April 2017. Mooney, represented by the Services Industrial Professional Technical Union, argued that his contract entitled him to the payment for regular rostered overtime. The Hospital said his new contract regraded him to Administrative Grade IV, an officer grade not eligible for the payment. The Court found that Mooney’s new contract gave him no entitlement to holiday premium payments and that overtime was excluded from the premium calculation. It could not recommend in favour of his claim.
