The Labour Court recommended that HSE West apply agreements on roster-day payments and leave accrued during night duty retrospectively to the date it purported to end them, and compensate those associated with the claim for resulting losses. The recommendation was signed on 28 April 2014. HSE West said it could no longer sustain the costs and needed to manage services more effectively. Services Industrial Professional Technical Union and Psychiatric Nurses Association argued that collective agreements covered both practices and sought retrospective allowances and restoration of time off in lieu. The Court said HSE West should use agreed dispute-resolution procedures to seek any variation or termination.
