The Labour Court disallowed Liam Davis’s age-discrimination appeal against Rgis Inventory Specialists Ltd. and affirmed the Equality Tribunal’s decision. The determination was signed on 29 April 2014.
Davis said he was 57 when he applied for a stock-controller post. He said that after he could not attend an induction session, the company did not offer another date and later rejected his application. RGIS denied that age played any part and said its system automatically generated the rejection after he missed the second session.
The Court found that Davis had not established facts from which age discrimination could be inferred. It said that although the treatment could appear unfair when viewed objectively, that alone was insufficient to support an inference of discrimination.
