The Labour Court recommended that Premier Periclase Ltd continue applying a pro-rata reduction to service leave when employees retire or leave during the leave year, upholding the practice challenged by Unite. Unite argued no company-union agreement allowed the reduction and sought an end to it. Premier Periclase Ltd said service leave was treated like annual leave and the practice had operated for more than 30 years. The Court found it had been in place for 33 years, was within industry norms and followed the company’s holidays agreement. The recommendation was signed on 24 August 2012.
