Labour Court rejects Donegal County Council worker’s vacancy claim

The Labour Court did not recommend that Donegal County Council concede an anonymised worker’s claim to be considered for a temporary vacancy in Letterkenny. The recommendation was signed on 20 December 2010. The worker said he ranked fourth on a temporary panel and should have been offered the Water and Environment Division post. He was willing to move closer to Letterkenny. The Council said the panel was for its Roads Division and the vacancy required someone living nearby who could respond to emergencies. The Court noted that the vacancy arose while the worker was already on a seasonal contract and that living close to the work area was an essential requirement. It considered it reasonable for the Council to offer the temporary contract to a local person because of the emergency nature of the work.
