The Labour Court recommended that 185 home care assistants be regarded as employees of the HSE, with past service recognised for pension purposes, in a dispute involving Eastern Community Works and the Services Industrial Professional Technical Union. The union argued that HSE was the actual employer and Eastern Community Works the paymaster. HSE generally agreed with that position, while saying Eastern Community Works' status prevented it from joining the superannuation scheme. The Labour Court hearing took place on 26 March 2008, and the recommendation was signed on 3 April 2008.
