The Labour Court recommended that Bus Eireann appoint an agreed external mediator to address a worker’s complaints of bullying and harassment and concerns about an unsuccessful job application. The recommendation was dated 4 December 2007 and called for mediation to restore a normal working relationship without apportioning blame.
The worker alleged he was treated unfairly in the selection process and that a manager’s conduct was intimidating. Bus Eireann said it had investigated the complaints under its procedures. The Court noted that informal and formal procedures, including an internal investigation, had been used, but the worker was dissatisfied with the result. It said the difficulties stemmed mainly from his concerns about safety matters and recommended that mediation receive priority and proceed without delay.
