The Labour Court recommended the immediate reinstatement of a cleaner dismissed by Dublin Waterworld Management Limited, which operates the National Aquatic Centre. The recommendation was dated 14 November 2006. The company said the worker had deliberately damaged a door, an allegation it said was supported by CCTV and a witness. SIPTU challenged the dismissal, citing the lack of formal machine training and failures to follow normal procedures. The Court found that the company had not followed its own grievance and disciplinary procedures and said summary dismissal was inappropriate. It recommended that the worker be placed at Stage 3 of the disciplinary process and receive counselling and further equipment training.
