The Labour Court upheld the Equality Officer’s decision and disallowed James Connolly’s appeal alleging gender and religious-belief discrimination by Kennedy Security Ltd in access to employment. The determination was dated 15 November 2006.

Connolly said he was told at interview that his beard did not fit the company’s corporate image and was not offered a security officer job. The company said his agitated behaviour at interview was the reason it did not offer him the position. The Court found no evidence that the company required him to shave or had a clean-shaven policy, and found he had not established facts supporting an inference of discrimination on either ground.
