Labour Court recommends Work 4U honour transferred workers’ contracts

By Cathal Brosnan

Labour Court ·

The Labour Court recommended that Work 4U Ltd continue to honour contracts carried over when it took over a supported-employment project, including the FÁS Grade 10 pay scale for eight workers. The recommendation was signed on 13 April 2006. The Irish Municipal, Public and Civil Trade Union said the workers were entitled to keep their existing pay scale and receive contractual increments. Work 4U said it had to follow FÁS guidelines to retain the project contract. The Court found the workers were entitled to retain their transferred contract terms and said reducing their pay would contravene their statutory rights. It recommended honouring the contracts unless the parties voluntarily agreed to change them.
