Labour Court upholds Dublin City Council reassignment of senior officer

By Tadhg O'Sullivan

Historic decision · Decision date:

Place: no local area assigned from the source.

The Labour Court upheld Dublin City Council’s decision to reassign a senior executive officer from her secondment to the Ballymun Regeneration Limited project and dismissed the union’s claim. The recommendation was dated 9 December 2005. The worker had sought to remain on the project until her secondment was due to end in October 2007. The Council said the City Manager could reassign staff at her level and needed to fill an important post elsewhere. The Court found that her appointment and secondment terms allowed reassignment, including when alternative arrangements were made.
