The Labour Court recommended that St. James's Hospital upgrade its Engineering Officer and Energy Services Officer posts from Grade 7 to Grade 8, effective from 25 February 2004. The recommendation was signed on 28 November 2005. The Irish Municipal, Public And Civil Trade Union sought the upgrades retrospectively, relying on national regrading and Health Services Employers Agency correspondence. St. James's Hospital argued that the letter concerned a Technical Services Manager post and that the claimants did not meet the stated criteria. The Court said the claim was supported by the correspondence and recommended it be conceded in these unique cases, without creating a precedent.
