In 2004, the Labour Court recommended that Dairygold pay the redundancy terms set out in its 2003 agreement without a cap. The recommendation was signed on 22 December 2004. The Services Industrial Professional Technical Union said the cap reduced some workers' entitlements, while Dairygold argued it was allowed under the agreement and cited changed economic circumstances. The Court said the agreement's payments were not discretionary and changed circumstances could justify seeking a review, but not departing from its terms unilaterally. It recommended a review under clause 15 by the end of January 2005.
