In a recommendation dated 7 December 1998, the Labour Court said Manor Foods Limited had applied the written probation terms in the case of a worker dismissed during probation. The worker had been absent without permission twice and did not contact the company, which said this breached its agreement with the union. The Services Industrial Professional Technical Union argued that the worker had not been properly informed about attendance requirements and that management had not followed the agreement. The Court recommended that employers take extra care at induction to explain agreement terms affecting employees’ continuing employment.
