In 1998, the Labour Court recommended that Forbairt (Enterprise Ireland) apply open-ended contracts to six workers employed on successive fixed-term contracts and that the parties meet to finalise arrangements. The recommendation was dated 28 September 1998. The Services Industrial Professional Technical Union brought the claim on the workers’ behalf. The Court found the workers’ terms and conditions were not materially different from those of comparable agency employees and said there was no justification for continuing their fixed-term contracts. The union had also sought grade 6 recognition for one worker for pension purposes, a claim not addressed in the recommendation.
