In 1998, the Labour Court recommended that Fan's Flowers pay Annette Mitchell £500 in compensation after finding the manner of her dismissal unfair. The recommendation was dated 24 September 1998. Mitchell said she left another job believing the flower shop would be a long-term venture. The company said operating losses of more than £3,000 in its first month left it no alternative but to cease trading, and that it had paid all wages and leave entitlements. The Court said start-up difficulties did not excuse the treatment. It found the business continued operating for weeks after Mitchell’s dismissal and that the manner of dismissal and her treatment the following day were unacceptable. The company submitted a written account but did not attend the hearing.
