In 1995, the Labour Court recommended that E.S.B. process a worker’s dispute over advertised driving positions at its Blanchardstown depot through the appropriate internal mechanism without further delay. The worker said the promotions should have been advertised and that he had lost the chance to apply. E.S.B. said the upgrades were based on seniority and were not substantive positions that had to be advertised. The Court called the 20-month delay in the recognised procedures totally unacceptable, while saying those procedures should continue during major negotiations within the company.
