In 1995, the Labour Court recommended that Iarnrod Eireann concede a claim by the Services Industrial Professional Technical Union and the National Bus and Railworkers Union for compensation for seven drivers transferred to the DART depot in Fairview. The recommendation was signed on 28 April 1995. The company argued that drivers had only three years to claim and that the compensation funds had been exhausted. The Court found that the three-year clause required repayment of a lump sum if a driver reversed an earlier choice not to operate the EMU within that period; it was not a time limit on eligible drivers claiming EMU duties.
