In 1995, the Labour Court recommended that the agreement between Boc Gases Ireland Limited and the Services Industrial Professional Technical Union on cylinder handling and transport should stand. The recommendation was signed on 20 February 1995. The union argued it had signed the agreement after receiving incorrect assurances from a shop steward, who later accepted responsibility and apologised. BOC Gases said the agreement was operating and employees had received its benefits. The Court found that the parties had negotiated and signed in good faith, had no reason to suspect problems when finalising the agreement, and had implemented it in full. It recommended that the agreement stand.
