The Labour Court upheld a recommendation of £1,500 in full and final settlement and rejected the Services Industrial Professional Technical Union’s appeal on Dublin Corporation’s treatment of a worker who missed out on a promotion. The decision was signed on 21 February 1995. The union, with the Irish National Painters and Decorators Trade Group, sought the worker’s reinstatement as a temporary foreman. It said he had 38 years’ service and that returning to his craftsperson grade would reduce his superannuation entitlements by £3,892.20. Dublin Corporation argued that candidates could rank lower or miss out on a temporary foreman panel in later competitions, and that unsuccessful candidates should not remain in the role.
