In 1994, the Labour Court found Colorman had not treated a casual worker unreasonably after he was unavailable for work during a lengthy absence. It recommended that the company recall him under its normal procedures if business improved. The recommendation was dated 13 October 1994. The worker said he had been unfairly dismissed while on certified sick leave and had not received a fair hearing. Colorman said his work was temporary, no position was available when he was ready to return, and his name remained on the casual workers’ list. The Court noted Colorman’s undertaking that all money due had been paid. It also noted that the worker remained on the casual workers’ list and recommended recall if business improved.
