Labour Court delays Bank of Ireland worker’s transfer after finding notice defective

By Cathal Brosnan

Labour Court ·

In 1993, the Labour Court recommended that Bank of Ireland not transfer a worker from his position before 1 May after finding the written notice was shorter than the prescribed and agreed time scale. The recommendation was signed on 15 February 1993. The Irish Bank Officials’ Association argued the transfer could cost the worker his shift premium and questioned its commercial rationale. The bank said transfers were a normal condition of employment and the move supported business development in Balbriggan. The Court did not accept the association’s commercial and shift-premium arguments, but said the defective notice could be misinterpreted against the background of the worker’s prominent role in 1992 industrial action.
