In 1991, the Labour Court recommended that a worker be allowed to apply for the next open painter vacancy at Dublin County Council, with the application assessed on its merits. The recommendation was dated 22 October 1991. The worker completed an apprenticeship with the council, then resigned from a general operative role in December 1988. He said other painters had been rehired and sought reinstatement as a full-time painter. The council said he had resigned voluntarily and was not entitled to reinstatement. The Labour Court found the council had met its obligations. It did not recommend reinstatement, but said the worker should be able to apply for the next vacancy, with no obligation on the council to treat his application otherwise than on its merits.
